An Aboriginal man in his fifties was not discriminated against on the ground of race or age when he was overlooked for promotion. The NSW Administrative Decisions Tribunal (NSWADT) found that the NSW Office of Environment and Heritage promoted another candidate to the position after it erroneously assessed the man’s capabilities.
